The Seller: Slutskaya Etery, the owner of Sunday's Child*RU cattery on the one hand, 

and the Buyer ____________________________, the passport ________ / ______________ issued ________________________________________________________________________

on the other hand, has concluded the present contract as follows:

 1.     The subject of the contract

The Seller undertakes to transfer to the Buyer's possession the following Animal:

 2.     Conditions of transfer

Till the moment of transfer the Animal should be vaccine twice by Fel-O-Vax, unitary from rabies. The animal should be processed also from worms and parasites. The seller guarantees absence at parents of the Animal HCM, FelV, and FIV. The buyer has the right to check up health of the Animal at own expense in the licensed veterinary clinics within seven days from the date of transfer. The seller is obliged to return on demand of the Buyer the sum paid for the Animal only after presentation of the conclusion about presence Animal's any diseases at the moment of transfer. Simultaneously with the refund the Buyer is obliged to return the Animal to the Seller. Simultaneously with transfer of the Animal the Seller is obliged to transfer the Buyer the veterinary passport, the transfer and the pedigree.

 3.     The price

    The Buyer undertakes to pay for the Animal is the sum equivalent ____________ euro. The price of the Animal does not include shipping charges. The seller is obliged to transfer the Animal in Sunday's Child cattery. The parties can coordinate other place of transfer. Within seven days after the conclusion of the contract the Buyer is obliged to pay to the Seller advance payment at a rate of a half price of the Animal. The remained part of the price should be paid by transfer of the Animal.

4.     The breeding class

 4.1 At the moment of transfer the Animal has following breeding class SHOW - BREED - PET (it is certain by the cattery owner or club).

 4.2 Parties recognize value of breeding work on improvement of Maine-Coon, including regular participation in cat shows and cultivation according to breeding programs which are coordinated by cattery owners and cat clubs. The parties recognize that mating of animals without the breeding permission is harmful to Maine-Coon development and break interests of the Seller as the cattery owner. The parties recognize that regular participation of kitten in the cat shows serves as acknowledgement of value of breeding work of the Seller as cattery owner. Proceeding from these positions, the Parties have coordinated following special treaty provisions:

4.2.1 For PET – CLASS animals.

The buyer has no right to use the Animal for breeding. The parties recognize that all the money obtained by the Buyer from sale of kittens, deduced with infringement of the given condition, are received without the appropriate basis and can be collected by the Seller from the Buyer as superficial enrichment. Besides it the Buyer is obliged to pay to the Seller the penal penalty at a rate of the Animal cost. The buyer is obliged to neuter the Animal within 7 months from the date of transfer. The buyer is obliged to give to the Seller under its requirement documentary acknowledgement of the lead neutering. In case such acknowledgement has not been given within 9 months from the date of transfer, the Seller has the right to consider, that the Animal is used for breeding and to demand from the Buyer the payment of the penal penalty at a rate of the Animal cost.

4.2.2      For SHOW – NEUTER CLASS animals.

The buyer has no right to use the Animal for breeding. The parties recognize that all the money obtained by the Buyer from sale of kittens, deduced with infringement of the given condition, are received without the appropriate basis and can be collected by the Seller from the Buyer as superficial enrichment. Besides it the Buyer is obliged to pay to the Seller the penal penalty at a rate of the Animal cost. The buyer is obliged to neuter the Animal within 7 months from the date of transfer. The buyer is obliged to give to the Seller under its requirement documentary acknowledgement of the lead neutering. In case such acknowledgement has not been given within 9 months from the date of transfer, the Seller has the right to consider, that the Animal is used for breeding and to demand from the Buyer the payment of the penal penalty at a rate of the Animal cost. The buyer is obliged to visit not less than six cat shows during first two years from the date of Animal transfer. The seller does not guarantee successes of the Animal at the cat shows.

 4.2.3 SHOW/BREED – CLASS animals.

The buyer is obliged to visit not less than six cat shows within the first two years from the date of the Animal transfer. The seller does not guarantee successes of the Animal at the cat shows. The animal can be mated only with the registered Maine-Coon cats. The buyer undertakes to mate a female not often then three times within two years. The buyer undertakes to mate a male with females from catteries of others, than cattery of the Buyer. No stud service for a male Maine-Coon.  The animal is sold for breeding purposes are guaranteed fertile. If a cat  is not able to reproduce at the latest until second year of life, and is believed to be infertile, the cat must be returned to the first breeder at the new owner's cost.  The cat should have a certificate of health, issued three days before returning to the first breeder. This certificate should contain the results of FIV and Fel V tests. Confirmation should also be given that the new owner's cattery is free from mycosis. When the cat is returned, the first breeder will endeavor to mate the cat in order to check for infertility. If the cat proves to be infertile, and it can be proved from the medical certificate that the infertility is the fault of the first breeder, the buyer will receive another cat. The buyer will, however, have to cover the costs of transportation. If the buyer would like to keep the infertile cat, the buyer will receive a discount.

With the sale of the animals produced from the Sunday’s Child cattery Animals, the Buyer undertakes to include in sales contracts conditions of neutering (for pet-class and show-neuter kittens) and mating conditions (for show/breed kittens), similar stated above in item 4.2.1 - 4.2.3 of a present contract.

5. Conditions of the maintenance

5.1 Animal should pass annual preventive veterinary survey and annual revaccinate. In case of illness the Animal should receive the duly veterinary help. The Animal should not to be contained in cages; can travel by street only with owner. Free walk is forbidden. Claw removal is forbidden. An animal or the kittens produced from this animal cannot be given or sold to laboratory or to a pet-shop. The buyer undertakes to feed the Animal only Premium or Super-premium food class.

5.2 observances of positions of item 5.1 of the present contract of the Party consider as conditions of the normal maintenance of the Animal. Deviation from the specified positions of the Party recognize as the proof of cruel treatment with the Animal. At presence of similar circumstances the Seller has the right to demand transfer to it of the Animal without payment of any monetary indemnification to the Buyer.

5.3 In case of the Animal death the Buyer is obliged to notify Seller immediately with the attachment of veterinary documents with the reasons of death.

6. The right of priority of purchase

The Buyer gets the Animal for him/herself personally. The buyer has no right to alienate the Animal without the consent of the Seller. If necessary to sell, exchange, present or otherwise to transfer the Animal to other person, the Buyer is obliged to inform Seller immediately, because the Seller has the primary right to take away the Animal and to return to the Buyer the money paid for Animal. If within 30 days from the moment of the notice the Seller has not informed the Buyer on intention to take advantage of the given right, the Buyer has the right to transfer the Animal to other person.

The parties have concluded the present contract, being in senses and sober memory. To the parties treaties provisions are clear all. The parties confirm the serious Intentions to observe all positions of the present contract which validity of the Party recognize and confirm.
